When Interpol Comes Calling…

You may be charged with: Crimes of Aggression (Replaces the term “crimes against peace”)

The crime of aggression is one of the four core crimes that gives the Court subject matter jurisdiction. However, it has become problematic because the drafters of the statute were unable to agree upon either a definition or the appropriate mechanism for judicial determination of whether or not the crime had actually occurred.

The Court will exercise jurisdiction over aggression once it is defined and its scope designated in a manner consistent with the purposes of the Statute and the ideals of the United Nations.

Today, it is considered a generic crime pending the definition of its elements by a prepatory committee or a review conference. No amendment to the Statute to define aggression and address the other issues can be entertained until July 1, 2009.
